Ponca City man convicted of assault and battery with a gun

NEWKIRK — Keith Wayne Cotton, 57, Ponca City, entered a plea of guilty in Kay County District Court to felony counts of assault and battery with a dangerous weapon and possession of firearms after a conviction.

Kay County D.A. Task Force agent John Garcia reports in the affidavit that he responded to the 900 block of S. 5th Street on March 26 for a report that Cotton shot at a vehicle. (see radio log entry)

The victim reportedly told Garcia that he and a friend went to Cotton’s salvage yard to purchase some car seats for $100. Cotton reportedly then told the victim that the seats would be $150. A disagreement ensued and the victim got into his vehicle to leave. He sped away after hearing gun shots.

He later reported finding bullet holes in the side of the vehicle.

Garcia made contact with Cotton who reportedly admitted to the disagreement. Cotton claims that the victim and his friend started yelling racial slurs and that he feared for his life so he got his gun and fired two shots into the air. Judge David Wilkie sentenced Cotton to six years in prison with all time suspended. He must also pay fines and restitution.
