Plea docket set in child neglect case

NEWKIRK — Blackwell resident Tera Ann McBrain, 43, is set to appear for a plea docket in Kay County District Court on Oct. 28.

A felony count of child neglect was filed against McBrain on Feb. 21. Blackwell police report in the affidavit that officers responded to McBrain’s residence on Sept. 27, 2018, after receiving a Facebook message from a juvenile stating his brother was trying to kill him.

Police arrived and report finding McBrain sleeping. Police arrested a juvenile in the home for assaulting another juvenile. McBrain reportedly told police that she heard the juvenile defendant drag the victim off the bed and listened to the pair fight.

She reportedly told police that she has witnessed the juvenile defendant abuse the victim many times but has not called police because she didn’t want him to be arrested. Police arrested McBrain and report she is accused of watching the juvenile defendant whip a juvenile with a belt, believed it was excessive, but did nothing. Police also report officers witnessed McBrain verbally abuse a juvenile. McBrain is free on on a $2,500 own recognizance bond.
