NEWKIRK — The case against Colton Randy Bay was dismissed in Kay County District Court on June 18. A motion to revoke a suspended sentence in a second case was also dismissed. The dismissals were ordered by Judge Jennifer Brock after a motion made by the state at the request of the victim.
Hearing set for Newkirk man accused of assaulting Arkansas City woman
NEWKIRK — A status docket is set for Colton Randy Kevin Bay, 24, Newkirk, in Kay County District Court on June 21.
Kidnapping, domestic assault and battery by strangulation and domestic abuse charges were filed against Bay on Dec. 18, 2018 after he was arrested by Ponca City police in the 3500 block of Pecan Road on Dec. 11.
Police report he is accused of assaulting an Arkansas City, Kan. woman.
The alleged victim reportedly told police that she reminded Bay he owes her $10. Bay reportedly started yelling, and hitting her while they were in a vehicle.
The woman told police he attempted to strangle her before she was able to get out of the vehicle. She was picked up by a motorist traveling eastbound on Hubbard Road, who took her to his house and called police.
Bond was set at $25,000 by Judge David Bandy. On Dec. 13 Bandy lowered bond to $5,000 and Bay was released on bond.
Bay’s criminal record in Kay County includes felony charges of endangering others while eluding police and running a roadblock. Those charges and a misdemeanor DUI were filed on May 25, 2017.
On March 21, 2018, he entered no contest pleas to those charges and was sentenced to five years in prison with all but 90 days in the county jail deferred.
However, on June 7, 2018, Bay attempted to withdraw his plea. The motion was denied and he was ordered to report to the county jail within 10 days. A motion to revoke the suspended sentence was filed on Dec. 18, 2018.
